In the application and interpretation of this Agreement, the terms written below shall express the explanations corresponding to them.

PARTIES: The SELLER and the BUYER,

CONTRACT: This contract concluded between the SELLER and the BUYER,

GOOD: The movable property subject to shopping and intangible goods such as software, sound, image, and similar prepared for use in electronic media.

SUBJECT

This Agreement regulates the rights and obligations of the parties in accordance with the provisions of the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts regarding the sale and delivery of the product with the features and sale price specified below, which the BUYER has ordered electronically through the website of the SELLER.

The prices listed and announced on the website are the sales prices. The announced prices and promises are valid until they are updated and changed. Prices announced for a specific period are valid until the end of the specified period.

GENERAL TERMS

The BUYER acknowledges, declares, and undertakes that by accepting this agreement, they have read and are informed about the basic characteristics of the product, the sales price, payment method, and delivery information on the SELLER's website in electronic form. The BUYER also acknowledges, declares, and undertakes that they have obtained accurate and complete information about the delivery of the product or service, including the address where the product will be delivered, on the SELLER's website.

The SELLER undertakes to deliver the product without any deficiencies, in accordance with the specified characteristics on the website, and, if any, with warranty documents, usage manuals, and all necessary information and documents in accordance with the legal requirements, to perform the job with accuracy and honesty in accordance with the legal regulations, to maintain and improve the quality of service, and to act with care and foresight during the performance of the work.

If necessary, the SELLER can supply a different product of equal quality and price by informing the BUYER and obtaining their explicit consent before the fulfillment of the contractual obligations.

In case the SELLER is unable to fulfill the obligations of the contract before the expiration of the performance obligation, the SELLER undertakes to notify the BUYER in writing within 3 days from the date of learning about the situation and to refund the total amount to the BUYER within 14 days. The BUYER has the right to cancel the contract in this case.

GENERAL PROVISIONS

• The BUYER acknowledges, declares, and undertakes that, by accepting this agreement, he/she has read and is aware of the basic qualifications of the product, the sales price, and the payment method, as well as the preliminary information about the delivery, on the SELLER's website in electronic form. The BUYER acknowledges, declares, and undertakes that he/she has accurately and completely obtained information about the address to be given by the SELLER, the essential features of the ordered products, the total price, including taxes, and the payment and delivery information before confirming the distance sales contract in electronic form.
• In the event that the SELLER cannot deliver the contracted product within the performance period due to force majeure or extraordinary circumstances such as adverse weather conditions that prevent transportation, disruption of transportation, and intervention of the official authorities, which could not be foreseen by the parties and are not their fault, the SELLER is obliged to notify the BUYER of the situation. In such a case, the BUYER may use one of the rights to cancel the order, replace the product with an equivalent if any, and/or postpone the delivery period until the preventing situation disappears. If the BUYER cancels the order, the payment will be refunded within 14 days from the notification of cancellation, and if there is a decrease in the campaign limit amount due to the cancellation, the discount amount used within the scope of the campaign will be canceled.

RIGHT OF WITHDRAWAL

• In case the right of withdrawal is exercised:
  a. If the goods are not suitable for return due to their nature (such as personal hygiene products, underwear, etc.) or if they are rapidly deteriorating, the BUYER cannot exercise the right of withdrawal.
  b. The SELLER is obliged to return all payments made, including the delivery costs of the returned goods, to the BUYER within 14 days from the date of receipt of the withdrawal notification, and to take back the goods within 14 days. The return of the price to the BUYER is made by the method of payment made during the purchase, and if it is not possible to return the price to the BUYER in the same method, it is made by contacting the BUYER.
  c. If the campaign limit amount set by the SELLER is reduced due to the exercise of the right of withdrawal, the discount amount used within the scope of the campaign is canceled.
  d. In case of withdrawal, the return cargo price is covered by the BUYER.
• The BUYER cannot use the right of withdrawal in the following contracts:
  a. Contracts for goods or services whose prices vary depending on fluctuations in financial markets and are not under the control of the SELLER or the provider.
  b. Contracts for goods prepared in line with the consumer's wishes or personal needs.
  c. Contracts for the delivery of perishable goods or goods with a short shelf life.
  d. Contracts for the delivery of durable goods.
  e. Contracts for the delivery of goods whose protective elements such as packaging, tape, seal, package have been opened after delivery; the return of perishable or expired goods.
  f. Contracts for services started with the approval of the consumer before the right of withdrawal expires.
  g. Contracts for the delivery of periodicals such as newspapers and magazines, other than those provided under the subscription agreement.
• The products to be returned must be delivered complete and undamaged, along with the box, packaging, and standard accessories, if any.

WARRANTY

• The SELLER is responsible for the compliance of the goods or services with the contract, in accordance with the conditions specified in the Law No. 6502 on the Protection of Consumers.
• The SELLER must deliver the goods or services in accordance with the qualifications specified in the order, complete, and together with the information and documents required by law, if any.
• If it is impossible to deliver the goods or services subject to the order, the SELLER must notify the BUYER of this situation before the performance obligation expires and return the total price to the BUYER within 14 days.
• If the consumer has paid the price of the goods, it must be returned within 14 days from the date of withdrawal.

SETTLEMENT OF DISPUTES AND AUTHORIZED COURTS

In disputes arising from this contract, the Consumer Arbitration Committees and the Consumer Courts where the BUYER has his residence are authorized up to the value declared by the Ministry of Customs and Trade.

If the order is approved by the BUYER electronically, it is deemed to have accepted all the terms of this contract.

FORCE MAJEURE

If the parties cannot fulfill their obligations due to force majeure incidents (natural disasters, war, terrorism, riots, changes in legislation, strikes, epidemics, etc.),the party concerned will not be responsible for the delay or failure to perform the obligation within the specified period. The parties are obliged to fulfill their obligations as soon as the force majeure situation ceases.

VALIDITY

This contract consists of 1 (one) page and 18 (eighteen) articles. The BUYER, by approving this contract electronically, accepts all the terms and conditions of the contract.
